CFRA (California Family Rights Act) is a health law for California residents. This law does not override FMLA (Family and Medical Leave Act) but was amended to mirror it. In 2005, out of 26,928 contracts, real property, and tort trials held in the United States, 60 percent of these trials were personal injury related cases. Some of the most popular personal injury cases in history are Anderson v. Pacific Gas and Electric and Grimshaw v. Ford Motor Company. In the case of Anderson v. Pacific Gas and Electric, the company was held accountable for its action of contaminating groundwater in Hinkley, California. The company was compelled to settle the cases for $333 million. This was the largest direct-action lawsuit payment in the history of the United States. In the case of Grimshaw v. Ford Motor Company, It was evidenced that the company’s production of 1970-1980 Ford Pinto was faulty. Ford Pinto had caused hundreds of burn death after rapturing of gas tanks whenever these vehicles had rear-end collisions. Ford recalled the Pinto and paid $3.5 million in punitive damages.

Car accidents are among the leading causes of injuries. In 2012, the United States recorded over 5.6 million car accidents, 30,000 of these accidents were fatal. Although the injuries involved vary from crash to crash or person to person, there are some common car accident injuries. These injuries include; head and back injuries, neck, and chest injuries. Most car accidents are characterized by head injuries that occur during high-speed collisions. The head injuries lead to traumatic brain injuries resulting in lasting cognitive problems and comas. The degree of severity of these injuries requires extensive and long-term medical intervention. The damage of the spinal cord and other back problems are also common in car accidents. The damaged spinal cord could result in critical nerve damage. This could leave the patient with a reduced sensation of the lower part of their body and paralysis in severe cases. Whiplash is another common car accident injury. An abrupt sudden movement of neck and head could cause serious damage to neck muscle and ligament. The neck injury could lead to vocal cord paralysis. The injuries sustained require immediate medical attention.

The car insurance company said I am a “prop 213”. What does that mean? Proposition 213 is a law that generally says you cannot recover for your pain and suffering in the car accident because you did not have car insurance at the time of the accident. Employment update on overtime pay: In order for a California employee to be exempt from getting paid overtime, the employee has to make a certain amount each month or per year. On January 1, 2016, minimum wage increased from $9.00 to $10.00. With this increase in minimum wage means that for an employee to be exempt from overtime, the employee’s monthly salary has to increase from $3,170 per month to $3,467 per month OR their yearly salary has to increase from $37,440 per year to $41,600 per year.
