Personal Injury
Uber and Lyft Accident Lawyer in Palmdale
If you were hurt in an Uber or Lyft crash, who pays depends on what the driver was doing in the app. Under California law, when a rideshare driver has accepted a ride or has a passenger in the car, the company's insurance must provide at least $1 million in liability coverage. If the app was on but no ride had been accepted, lower limits apply. If the app was off, the driver's personal insurance applies. Take screenshots of your trip, get medical care, and talk to a lawyer before you talk to the insurer.

| What the driver was doing | Coverage that usually applies |
|---|---|
| App off | The driver’s personal auto insurance |
| App on, waiting for a ride | Rideshare company coverage: at least $50,000 per person and $100,000 per accident for injuries, plus $30,000 for property damage |
| Ride accepted, driving to pickup | Rideshare company coverage of at least $1,000,000 |
| Passenger in the car | Rideshare company coverage of at least $1,000,000 |
These are the minimums under California Public Utilities Code 5433. Uninsured and underinsured motorist coverage may also apply.
What to do after a rideshare crash
- Get medical care.
- Take screenshots of the trip in your app before they disappear. Note the driver’s name and car.
- Report the crash in the app and to the police.
- Get names of witnesses and the other driver.
- Do not give a recorded statement to the rideshare company’s insurer before you talk to a lawyer.

A rideshare driver hit my car. Can I claim against Uber or Lyft?
It depends on the driver's app status at the moment of the crash. We can find out through the insurers and the rideshare company's records.
