Pedestrian Accident Lawyer in Palmdale

The short answer

If a car hit you while you were walking in Palmdale or Lancaster, get medical care right away and get the police report number. In California, drivers must yield to pedestrians in any crosswalk, marked or unmarked (Vehicle Code 21950). Even if you were not in a crosswalk, you may still recover money, because California reduces your recovery by your share of fault instead of barring it. You have two years to file an injury lawsuit.

Why pedestrian crashes cause severe injuries

A person on foot has no protection. Pedestrian crashes often cause broken legs and hips, head injuries, spinal injuries, and internal injuries. Recovery can take months and may require surgery and therapy.

Where pedestrians get hurt in the Antelope Valley

  • Wide, fast streets like Palmdale Boulevard, Rancho Vista Boulevard, Avenue K, and 10th Street West, where people must cross many lanes
  • Areas with no sidewalks or streetlights, common in east Palmdale, Littlerock, and Lake Los Angeles
  • Shopping center parking lots, where drivers are looking for spaces instead of people
  • Near schools and bus stops, early in the morning and after dark
  • Walkable downtowns like The BLVD in Lancaster and Old Town Newhall

Common causes

  • Drivers turning left or right without looking for people in the crosswalk
  • Speeding and running red lights
  • Drivers backing out of parking spaces
  • Distracted and drunk driving
  • Poor visibility at night, with low light and dark clothing

FAQ

Frequently asked questions

What is an unmarked crosswalk?

At most intersections, the area where the sidewalks would meet counts as a crosswalk even with no painted lines. Drivers must yield to you there too.

I was crossing in the middle of the block. Do I have a case?

Possibly. Since 2023, California's "Freedom to Walk" law limits tickets for crossing outside a crosswalk when it is safe. Drivers still have a duty to watch for people on foot. If you share some fault, your recovery is reduced, not eliminated.

Who pays if the driver has no insurance?

Your own auto policy's uninsured motorist coverage may cover you even when you were walking. Health insurance and medical payments coverage may also help. We will look at every option.

I was hit in a parking lot. Is that different?

Parking lot crashes are common and still count. The driver may be at fault, and sometimes the property owner is too, if poor lighting or layout played a role.
