Who can file a wrongful death claim in California?

Under Code of Civil Procedure 377.60, the surviving spouse or domestic partner, children, and grandchildren of a child who has died. If none of them survive, the people who would inherit under state law may file. Some dependents, such as stepchildren or parents who relied on the person financially, may also qualify.

What is the difference between a wrongful death claim and a survival claim?

A wrongful death claim pays the family for their own losses. A survival claim is brought by the estate for losses the person had before they died, such as medical bills. Many cases include both.

Is there a criminal case too?
