Personal Injury

Sports Injury Lawyer in Palmdale

The short answer

In California, people who play a sport accept its inherent risks, such as getting tackled in football. That rule is called "primary assumption of risk." But a coach, league, gym, or facility owner can still be responsible if they made the activity more dangerous than it has to be. Examples are broken equipment, unsafe fields or courts, poor supervision of children, or pushing an injured player back into a game. Coaches and other players can also be responsible for reckless or intentional conduct.

Common causes of sports and recreation injuries

  • Broken bleachers, fences, and backstops
  • Poorly maintained fields, courts, and gym floors
  • Defective helmets, pads, and equipment
  • Gyms with broken machines or no instructions
  • Coaches who ignore head injuries or heat illness
  • Poor supervision of children and teens

Antelope Valley summers are hot. Heat illness at practices and games is a real risk, and coaches must allow water and rest.

Concussions and youth sports

California has laws requiring youth sports organizations to remove a player suspected of a concussion and to require medical clearance before they return. When those rules are ignored, a second head injury can be devastating.

FAQ

Frequently asked questions

I signed a waiver. Can I still bring a claim?

Waivers are often enforceable in California, but not always. A waiver does not protect a business from "gross negligence," meaning an extreme departure from ordinary care. How the waiver is written also matters. Bring it to us.

My child was hurt in youth sports. Who is responsible?

It depends on what happened. A league, school, or coach may be responsible for poor supervision, unsafe equipment, or ignoring signs of a concussion. School districts are public agencies, so a six-month claim deadline usually applies.

Another player hurt me. Can I sue them?

Only if their conduct was reckless or intentional and went beyond the ordinary rough play of the sport, such as a punch thrown after the whistle.
