Personal Injury

Amusement Park Injury Lawyer in Palmdale

The short answer

California courts treat roller coaster and thrill ride operators like "common carriers," which means they owe riders the highest degree of care (Gomez v. Superior Court, 2005). If you or your child was hurt on a ride at a theme park, a county fair, a water park, or a trampoline park, report it before you leave, get the names of employees, photograph the ride and your injuries, and get medical care. You usually have two years to file, and six months if a public agency runs the park or fair.

FAQ

Frequently asked questions

Who inspects rides in California?

Cal/OSHA's Amusement Ride and Tramway Unit inspects permanent amusement rides, and portable rides at fairs must also meet state safety rules. Inspection records can be important evidence.

The ticket said the park is not responsible. Is that true?

Not necessarily. Fine print on a ticket or waiver does not always protect a park, especially when a ride was poorly maintained or operated.

My child was hurt at a birthday party at a trampoline park. What now?

Get medical care, keep the waiver if you signed one, and get the names of staff. Trampoline parks must supervise jumpers and keep equipment in good repair.
